Sleep Country Canada and Bianca Andreescu have come together to get Canadians to make time for getting healthy sleep.

More than a year in the making, the partnership has the tennis star stepping into a role as the retailers first-ever brand ambassador, and she features prominently as a champion for sleep in the companys new TV and digital campaign, Theres No Dream Without Sleep.

The partnership and the new campaign are both continuations of a strategy that began last year, according to Stewart Schaefer, Sleep Country Canadas president, who says that amid the pandemic, the company moved away from its iconic Why buy a mattress anywhere else? tagline to one focused more on health and wellness Sleep well, stay well.

Sleep Country Canada reached out to Andreescu after she won the U.S. Open in 2019, Schaefer says. Discussions were had in late 2019 and earlier 2020, but then the pandemic hit and the retailer was forced to focus on other things in its marketing, though a partnership with Andreescu remained in the retailers back pocket.

Last week, a Federal Court judge agreed to Sleep Countrys request for a temporary injunction that bans Sears from continuing to use a marketing tag line until at least the trademark infringement matter is decided at a trial, which could be as long as 24 months from now.The Globe and Mail

A fight over mattress marketing may keep some retail executives up at night.

Struggling department-store retailer Sears Canada Inc., which has put a push on selling its mattresses, started about six months ago to pitch those products with the advertising slogan “There is no reason to buy a mattress anywhere else.”

Rival specialty chain Sleep Country Canada Inc., whose long-time jingle “Why buy a mattress anywhere else” rings familiar with many consumers, didn’t take the Sears slogan lying down.

Last week, a Federal Court judge agreed to Sleep Country’s request for a temporary injunction that bans Sears from continuing to use its marketing tag line until at least the trademark infringement matter is decided at a trial, which could be as long as 24 months from now.

Foam mattresses are becoming much more popular, and they tend to get higher customer satisfaction ratings than innerspring mattresses . There are two major types of specialty foam, and a foam bed will usually have at least one of them, if not both. There is latex, and memory foam.

The Canadian Federal Court rarely grants interlocutory injunctions in trademark cases, but for the second time in two years, an interlocutory injunction has been granted, this time in Sleep Country Canada Inc. v Sears Canada Inc.1 The Court held that the impossibility of quantifying damages supported a finding of irreparable harm, and, following many recent Federal Court decisions, was prepared to rely on its own analysis of the facts, as opposed to expert evidence, to find that the defendants slogan was confusing.

The question for trademark owners is whether Sleep Country signals a new willingness by the Federal Court to grant interlocutory injunctions in trademark cases, or whether the decision is restricted to its particular facts involving a well-known mark and arguably blatant infringement.
